- The Setup: Wife seeks divorce, offers to return dowry.
- The Twist: Husband declines the refund!
- The Reason: All about the children.
- The Verdict: Court grants the divorce anyway.
Husband Says No to Dowry Refund
Aliyu Sulaiman, a businessman, made a bold statement in a Kaduna state Shari’a court. His wife, Zainab Sulaiman, sought a divorce and offered to return the N14,000 dowry he had given her. But Aliyu refused to take it back! This happened at a court sitting in Rigasa, Kaduna state.
Why Refuse the Money?
Aliyu’s reason was simple: their children. He told the court that he wouldn’t accept the dowry refund because of them. “I agree that the marriage should be dissolved. The court can grant my wife her prayer for divorce,” he stated. It seems he wanted to make a point about his commitment to his children, even as the marriage ends.
What is Khul’i Divorce?
Zainab requested the court to dissolve their marriage through Khul’i (redemption). This is a type of divorce where the wife offers compensation, in this case, the dowry, in exchange for ending the marriage. This is her right, according to Shari’a Law.
The Court’s Decision
Malam Muhammad Adamu, the Judge, acknowledged Aliyu’s decision. Since Aliyu willingly declined the dowry, which is his right under Shari’a law, the court respected his choice. The Judge then declared the marriage dissolved, stating, “I Muhammad Adamu- Shehu hereby dissolve the marriage between Zainab Sulaiman and Aliyu Sulaiman.”
